FORT BENNING, Ga., (Nov. 6, 2013) -- A military judge sitting alone as a general court-martial on Oct. 10 convicted Pvt. Avus M. Brooks, Headquarters and Headquarters Company, 2nd Battalion, 69th Armor Regiment, 3rd Armored Brigade Combat Team, pursuant to his pleas of five specifications of communicating a threat in violation of Article 134, Uniform Code of Military Justice, four specifications of wrongful use of a controlled substance in violation of Article 112a, UCMJ, one specification of violating a general regulation in violation of Article 92, UCMJ, two specifications of behaving disrespectfully toward an NCO in violation of Article 91, UCMJ, one specification of behaving disrespectfully toward a commissioned officer in violation of Article 89, UCMJ, and one specification of absenting himself without leave in violation of Article 86, UCMJ.

Brooks pleaded guilty to three instances of wrongfully using marijuana, one of wrongfully using cocaine, and another of violating the Army regulation prohibiting the use of synthetic cannabinoids like Spice.

He also pleaded guilty to absenting himself without leave between Oct. 24, 2012, and Jan. 7, 2013. Brooks pleaded guilty to communicating a threat to a noncommissioned officer on Sept. 7, 2012, and behaving disrespectfully to an NCO May 23, 2013.

The remaining charges against Brooks arose from his placement into pre-trial confinement on June 4, 2013. Brooks pleaded guilty to an additional four specifications of communicating threats to NCOs and a Department of the Army law enforcement officer and two specifications of behaving disrespectfully -- toward an NCO and a commissioned officer -- at the time of his incarceration.

Sentenced to 15 months confinement and a bad-conduct discharge, Brooks received credit for time served since he was placed in pre-trial confinement on June 4, 2013.
