Fort Bragg staff judge advocate answers survivors' questions about entitlements
March 18, 2011
FORT BRAGG, N.C. - When a person's status changes, they often have questions about whether their entitlement to services has changed.
At Fort Bragg, we are home to three legal assistance offices that can help survivors with legal issues during the difficult time of transition, dealing with probate and estate issues, and also afterward with preparation of new estate planning documents for the survivors whose situations have changed. As long as a survivor maintains a valid military identification card, they remain entitled to services at the legal offices. (For example, remarriage to a non-servicemember would terminate entitlement.)
The headquarters Fort Bragg Office of the Staff Judge Advocate is located on the corner of Armistead and Macomb streets. The 82nd Airborne Division's Office of the Staff Judge Advocate is located on the 2nd floor of Gavin Hall, Room 273. Additionally, the 1st Theater Sustainment Command has a legal assistance office located off Quartermaster Street.
The LAOs provide a variety of services. The front desk can provide several types of powers of attorneys, including general, special, guardianship for children, privately own vehicle, DEERS and ID card, real estate, and several others to fulfill most power of attorney needs. Additionally, LAO paralegals and attorneys can provide notary public services.
If you are still working with your casualty assistance officer, please have that individual contact our office to schedule you an appointment. If you no longer have an appointed person assisting you, you can contact our office yourself.
Appointments can be made to meet with a LAO judge advocate who can provide legal assistance for a variety of legal issues. LAO judge advocates can provide services that deal with bankruptcy and debt issues, estate planning, landlord/tenant issues, identity theft, fraud/scams, immigration/naturalization and taxes. Wills, living wills and powers of attorney can be updated at any time by a person with a valid identification card.
It is highly recommended that survivors contact our tax center regarding the filing of taxes for the year involving the death of a spouse. There are special considerations with which non-military tax preparers may not be familiar.
The headquarters Fort Bragg Legal Judge Advocates will see appointments Monday, Tuesday, and Friday mornings. Appointments are made the last working day of every week via the telephone or by coming into the office. Thursdays are devoted to Family law issues. It is important to identify yourself as a Gold Star Survivor so appropriate priority can be given to scheduling the appointment.
